What are the Trusted Sellers T&Cs?

1.ABOUT THE MARKETPLACE AND YOUR CONTRACT
1.1 Marketplace operator. Argos Marketplace (the "Marketplace") is provided by Argos Limited ("Argos", "we", "us", "our"). We operate argos.co.uk and the Argos app (together, the "Site"). Our company details are set out in Section 16. We allow other companies ("Trusted Seller" or "Trusted Sellers") to list and sell their products on the Site via the Marketplace. In addition to operating the Marketplace, Argos also sells certain products directly to customers in its own capacity as a retailer ("Argos Retail").
1.2 Which terms apply to your purchase. The terms that apply to your purchase depend on who you are buying from:

  • Marketplace purchases: Where you buy a product from a Trusted Seller, your contract is with the Trusted Seller of that product, not Argos, and these terms and conditions ("Marketplace Terms") apply. Please read these Marketplace Terms carefully before ordering any products from Trusted Sellers on the Site. Exhibit 1
  • Argos Retail purchases: Where you buy a product sold directly by Argos (and not from a Trusted Seller), your contract is with Argos and the Argos Terms & Conditions apply instead. Please read the Argos Terms & Conditions carefully before ordering any Argos Retail products from the Site. If your order includes a combination of products sold by Argos Retail and Trusted Sellers, the Marketplace Terms will apply to the parts of the order that relate to products sold and delivered by Trusted Sellers, and the Argos Terms & Conditions will apply to Argos Retail products.

1.3 Identifying Marketplace Sellers. Where a product is sold by a Trusted Seller, the product page will state: "Sold & delivered by Trusted Seller". You will see this on product pages, in the trolley, at checkout, in your order confirmation, and in post-order communications. Please see Trusted Seller help page for more information.
1.4 Argos' role in Marketplace transactions. For Marketplace purchases, that is, products that are identified as "Sold and delivered by Trusted Seller", the Trusted Seller is responsible for the product and aftersales support. We provide the online platform, order routing technology and payment collection facilities that enable Trusted Sellers to sell their products directly through the Site. We are not the manufacturer, supplier or seller of those products.
1.5 Trusted Sellers' responsibilities. Trusted Sellers are responsible for legal compliance of their listings and contracts, including product safety, accurate descriptions, pricing and delivery, and for handling cancellations, returns and refunds in line with UK consumer law.
1.6 Your rights as a consumer. If you are a consumer (buying mainly for personal use), you have legal rights that can't be limited or removed by these Marketplace Terms. We'll explain how they apply below.
1.7 Changes to these Marketplace Terms. If we change these Marketplace Terms:

  • Any changes will be published on the Site with the "Last updated" date.
  • Changes will have immediate effect but won't affect existing orders.
  • If you keep using the Site after we make any changes, this means you accept those changes.
  • Your order will be governed by the Marketplace Terms in force when you placed it, unless a change is required by law.

2.USING THE SITE
2.1 Personal use only. You may use the Site for personal, non‑commercial purposes only and must use them lawfully. You must not use them in a way that infringes the rights of others or restricts or interferes with anyone else's use of the Site. The Site is intended for use by customers aged 18 or over and is not aimed at children.
You may not copy, reproduce, scrape, republish, distribute, or otherwise use any part of the Site or content for commercial purposes, or in any way not expressly permitted by these Marketplace Terms, without our prior written consent.
2.2 Account registration. You can create an Argos account to use certain features of our Site. To do this, we'll ask you for some required personal information. You can also place orders using guest checkout without creating an account. Please see our Privacy Policy for details of what personal information we collect, how we use it, and how it's stored. You must make sure that any information you give us is accurate and kept up to date. You can review and update your details at any time in Your Account.
2.3 Passwords and security. You'll need to create a password when you set up an account. Please keep it secure and don't share it with anyone. You're responsible for activity carried out through your account. If you think someone else may have accessed your account, please contact us as soon as possible. If we reasonably suspect fraud or misuse of an account, we may take appropriate steps, including restricting access to, or closing, your account – see Section 10 below.
2.4 Misuse of the Site. You must not misuse the Site (e.g., by attempting to bypass security, place orders in breach of these Marketplace Terms, or disrupt the service). If we reasonably believe there has been misuse, we may take appropriate steps such as cancelling affected orders, requiring extra checks, or restricting access to, or closing, your account as described in Section 10 below.
2.5 Customer reviews. Customer reviews help other shoppers make informed decisions, so it's important they are genuine and transparent. You must only leave reviews that reflect your own genuine experience of the product. If you've been offered an incentive for leaving a review (e.g., a free product or reward), you must clearly disclose this in your review. As reviews must reflect your genuine and independent opinion, they must not be influenced by the incentive (e.g., where an incentive is only offered for leaving a positive review). Content shared by other users reflects their own views, not the views of Argos, Trusted Sellers, or their respective group companies.

3.LISTINGS AND PRODUCT INFORMATION
3.1 Who creates listings. Listings are created by Trusted Sellers. Trusted Sellers must ensure that descriptions, specifications, compatibility, images and any other important characteristics are accurate. Please note that:

  • packaging may differ from the images shown;
  • weights, dimensions and capacities are approximate;
  • colours may look different depending on your device or screen settings; and
  • all items are subject to availability. If something you order is unavailable, we'll let you know as soon as possible.

4.ORDERING AND CONTRACT FORMATION
4.1 How to place an order. See our How to Place an Order page.
When you place an order on the Site which includes any products sold by a Trusted Seller, that part of your order will be subject to the Trusted Seller's acceptance under these Marketplace Terms.
You will have an opportunity to check and correct any input errors in your order up until the point at which you submit your order by confirming your payment on the "Confirm and Pay" page. No amends can be made by you to your order after this point.
After you place an order on the Site, we will send an acknowledgement email confirming we received it. This is not acceptance.
4.2 If your order can't be accepted. There may be scenarios where the Trusted Seller can't accept an order, for example:
• the item is out of stock;
• payment cannot be authorised;
• there is a pricing / description error (see Section 5); or
• there is a reasonable suspicion of fraud or misuse.
If this happens, we will notify you of the cancellation and refund payment taken for the applicable item(s), including any delivery charges if the Trusted Seller can't accept any part of your order.
4.3 When the contract starts. Your contract with the Trusted Seller is not formed until the Trusted Seller formally accepts your order. Acceptance takes places when you receive an email from us on the Trusted Seller's behalf confirming that the order has been despatched.
4.4 If your order cannot be completed. In limited circumstances, the Trusted Seller may not be able to complete an order (or part of an order) after it has been confirmed. This may happen, for example, if:
• you do not meet the eligibility requirements (including age restrictions – see Section 8); or
• a product is lost, destroyed or goes missing before it is delivered to you (or somewhere / someone authorised by you).
If this happens, we will notify you and refund payment taken for the applicable item(s), including any delivery charges if the Trusted Seller cancels your entire order.
4.5 Order limits and fair use. Trusted Sellers may apply reasonable limits to quantities per order / customer where needed to ensure fair access for other customers, prevent misuse, or address health and safety concerns. Where a Trusted Seller does this, we will make this clear at checkout or shortly afterwards.

5.PRICE, PAYMENT AND TRANSPARENCY
5.1 Prices set by Trusted Sellers. Prices are shown in GBP and include VAT where applicable. Delivery charges (if any) are shown clearly before you pay. All unavoidable fees will be included or clearly disclosed upfront. Optional extras will be opt in (not pre ticked) and clearly priced. Prices are subject to change, but such changes won't affect orders already placed (unless there's an error – see Section 5.3 below).
5.2 Payment timing. Unless stated otherwise for a particular payment method, we collect payment on the Trusted Seller's behalf after you place your order, before it's despatched.
5.3 Pricing errors. If a genuine pricing error is identified by the Trusted Seller before dispatch, we will contact you and give you the option to:
• proceed at the correct price, or
• cancel for a full refund.
If we or the Trusted Seller can't reach you within a reasonable period, the Trusted Seller won't be able to accept your order, and we'll issue a refund.
5.4 Checks to prevent fraud. We may carry out checks to help protect customers, Trusted Sellers and Argos from fraud. This may include checking the name, address and other personal information you provide against appropriate third-party databases.
• By accepting these Marketplace Terms, you agree to these checks being made.
• To carry out the checks, we may share your personal information with a registered Credit Reference Agency, which may keep a record that a check was made.
• These checks are only to confirm your identity and help prevent fraud. They are not a credit application and will not affect your credit rating.
• We will handle your personal information securely and in line with applicable data protection laws. If a check fails, we may pause or cancel the order and may ask you to confirm certain details.
5.5 Payment methods. See our Payment Types help page. Additional terms may apply for Klarna, PayPal, etc., and will be shown to you at checkout.
5.6 Gift cards. Argos gift cards and Love2Shop gift cards can't be used to purchase products sold and delivered by Trusted Sellers.
5.7 Discount codes. Unless otherwise stated for a given promotion, discount codes (including colleague discounts) can't be used to purchase products sold and delivered by Trusted Sellers.
5.8 Argos Pay. Argos Pay cannot be used to purchase products sold and delivered by Trusted Sellers.

6.DELIVERY AND RESPONSIBILITY
6.1 Delivery arrangements. Delivery is arranged by the Trusted Seller (or their carrier). Estimated delivery times are shown on the product page and/or at checkout. Delivery is only available to addresses in UK. Customers outside this area may still place an order for delivery / collection within the UK.
6.2 Delivery times. Delivery dates and times shown at checkout are estimates unless you agree a specific delivery time with the Trusted Seller (e.g., next day delivery). Trusted Sellers will aim to deliver within those estimated timescales. However, delays may occur due to unforeseen reasons. If delivery is late, you may have legal rights (including the right to end the contract in certain circumstances). See Section 6.4 for more details.
6.3 If no one is available. If a delivery requires someone to be present and no one is available, the Trusted Seller may need to rearrange delivery and may charge a reasonable redelivery fee – they will inform you of this before any redelivery fee is charged.
6.4 If delivery is late (your legal rights). If a Trusted Seller doesn't deliver the goods by the estimated delivery date, you may require delivery within a further reasonable period. If the Trusted Seller has said that they won't deliver the goods, you will be entitled to a refund for any goods not delivered, including the delivery charge if the entire order isn't delivered.
6.5 Responsibility after delivery. Once the products are delivered to your address, or left with someone or somewhere you have chosen, they become your responsibility and you become the owner.
6.6 Proof of delivery. Carriers may ask for a signature or capture a delivery photo as proof of delivery. All photographs will be stored in accordance with data protection laws.
6.7 £100 Free Delivery Threshold. Products sold and delivered by Trusted Sellers won't count towards the £100 Free Delivery Threshold.

7.AGE-RESTRICTED PRODUCTS
7.1 Some of the products sold by Trusted Sellers can only be bought by people who meet certain legal age requirements. By law, Trusted Sellers can't sell these to anyone who is under the required age. If you don't meet the relevant age requirement, you must not try to buy these products through the Site, or on behalf of someone who is underage.
7.2 Examples of age‑restricted products include:
• Knives and bladed items – including kitchen knives and cutlery knives. These products can only be purchased by, and for, customers aged 18 or over.
• Video games – video games can only be purchased by, and for, customers who meet the applicable age rating (e.g., as set by PEGI or any other relevant age‑classification system).
• Alcohol – alcohol can only be purchased by, and for, customers aged 18 or over.
7.3 By placing an order for an age‑restricted product or service:
• you confirm you meet the relevant age requirement and acknowledge that it may be an offence to make a false declaration;
• you may be asked to complete age checks at the point of purchase, collection, and/or delivery in line with our Think 25 policy; and
• if you can't prove age at the point of purchase, receipt or collection, the Trusted Seller will refuse supply and cancel the order with a refund for that product.
7.4 In line with our Think 25 policy, Trusted Sellers reserve the right to request proof of age from anyone purchasing age‑restricted products who they reasonably believe may be under the age of 25. The following forms of identification are accepted:
• a valid passport, or an equivalent photo ID showing your date of birth (such as a national identity card);
• a valid driving licence, including provisional licences; • NI Electoral ID cards (accepted in Northern Ireland);
• UK military ID cards; and • Proof of age cards bearing the PASS logo, such as a CitizenCard or Young Scot card.
7.5 Some age-restricted items (including knives and other bladed articles) aren't eligible for locker collection and must be collected in person.

8.RETURNS, CANCELLATIONS AND REFUNDS
8.1 Summary. The Trusted Seller Returns Policy explains how returns work and the options available to you. It forms part of these Marketplace Terms, and we recommend reading it carefully before placing an order, so you know what to expect. In summary, our Trusted Seller Returns Policy sets out:
• The Marketplace 30-Day Standard Returns Policy;
• Your additional legal right to cancel online orders within 14 days; and
• Your additional legal remedies if goods are faulty or damaged.
8.2 Argos 30-day Standard Returns Policy. If you've changed your mind and wish to return an item, you have 30 days from the date of delivery to request to return your item(s) under the Marketplace 30-Day Standard Returns Policy, and a further 30 days to return the item. Please refer to the Trusted Seller Returns Policy for full details, including applicable exemptions from return rights, how and when to request a return, when to expect your refund, and what (if any) collection costs may apply.
8.3 Statutory right to cancel. In addition to the Marketplace 30-day Standard Returns Policy, for most goods bought online, you have the statutory right to cancel your order for any reason within 14 days beginning with the day after you (or your nominee) receive the item. These rights are based on the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
If your order contains multiple products delivered on different days, the 14-day period runs from the day after the last item arrives. Please refer to the Trusted Seller Returns Policy for full details.
8.4 If your product is faulty. If goods are not satisfactory quality, fit for purpose, as described, or otherwise do not conform to the contract (i.e. "faulty"), you are entitled to legal remedies. These rights are based on the Consumer Rights Act 2015. These may include a repair, a replacement, or a refund.

8.5 Refunds. The Trusted Seller must provide a refund within 14 days of receiving the goods back (or receiving evidence that you sent them), using the original payment method. The refund will be for the price of the goods and will include the basic delivery fee charged by the Trusted Seller, but not any additional charges you may have paid for enhanced or next day delivery. Trusted Sellers may make a deduction for any diminished value caused by handling beyond what is necessary to check the goods (e.g., more than you could do in a shop). Please refer to the Trusted Seller Returns Policy for full details.

9.INTELLECTUAL PROPERTY
9.1 All copyright, trademarks and other intellectual property rights in our Site and content belong to Argos or our licensors, unless stated otherwise.
9.2 You may use the Site and content for your personal, non‑commercial use only. This includes viewing content on your device or printing a single copy for your own personal use.
9.3 You must not copy, reproduce, modify, distribute, publish, sell, or otherwise use any part of the Site or content for commercial purposes without our prior written permission, or help anyone else to do so.
9.4 You must not use any automated means (such as bots, scraping tools, or similar technologies) to copy, collect, or analyse content from the Site unless we have given you prior written permission. This includes using our content to develop or train artificial intelligence or machine‑learning systems.
9.5 Nothing in these Marketplace Terms grants you any licence to use Argos or Trusted Seller trademarks or branding.

10.OUR RIGHT TO SUSPEND OR CANCEL YOUR ACCOUNT
10.1 We may suspend or cancel your account if you seriously or repeatedly break these Marketplace Terms, or if we reasonably believe that your use of the Site is unlawful or could cause harm to us, Trusted Sellers, other customers, or the Site.
10.2 Where possible, we will give you notice before doing so and explain why, unless we need to act immediately for legal, security or safety reasons.
10.3 Suspending or cancelling your account will not affect any rights or responsibilities that either you or the Trusted Seller have already acquired under these Marketplace Terms, including your statutory rights relating to faulty goods or cancellations as explained in Section 8 above.

11.SITE LIABILITY
11.1 Products must match the contract. Trusted Sellers have a legal duty to supply products that conform with these Marketplace Terms. However, neither we nor Trusted Sellers accept liability for any loss that is not reasonably foreseeable, nor for any business‑related losses (including loss of profits, contracts, goodwill, opportunities, or similar losses).
11.2 Instructions and guidance. You must follow any instructions or guidance provided by us or the Trusted Seller to ensure the products are used and stored safely, including any information set out in product manuals or accompanying materials. The Trusted Seller will not be liable for any damage to the products resulting from your failure to follow this guidance.
11.3 Argos' responsibility. Argos is not part of your contract with the Trusted Seller and is not responsible for the products you buy from Trusted Sellers, or for delivering them to you. We provide the online platform, order routing technology and payment collection that enable Trusted Sellers to sell their products directly through the Site (see Section 1.4). However:
• We can't guarantee that the Site will always be available, free from errors, or free from viruses or bugs.
• We can't guarantee that any issues will be corrected, or that all content on the Site will always be accurate, reliable, or fully functional.
• We aren't responsible for any loss of content or material you upload to, or send through, the Site.
• We aren't liable for any loss or damage that results from actions taken (or not taken) based on information on the Site. In addition, we use reasonable security measures to protect your order and payment details. Unfortunately, no system can be completely secure. We won't be responsible for losses caused by unauthorised access to your information where this occurs despite us taking reasonable care, and we have not breached our legal obligations.
11.4 No exclusion of your consumer rights. Nothing in these Marketplace Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under law. In addition, nothing in these Marketplace Terms, including Section 11.3, affects your legal rights in relation to faulty goods, late delivery, cancellations, or refunds.

12.EXTERNAL LINKS
12.1 The Site may include links to third‑party websites that we think you may find useful. These websites are operated independently from Argos and are not under our control. We do not review or approve their content and are not responsible for their availability, accuracy, or the way they operate. If you choose to access a third‑party website, you do so at your own risk.

13.NECTAR
13.1 Collecting Nectar points. You will be able to collect Nectar points on products sold and delivered by Trusted Sellers. If you use Nectar, you'll earn points on your Marketplace purchases at the same rate, and under the same terms and exclusions, as when you buy products directly from Argos Retail.
13.2 Spending Nectar Points. You won't be able to spend Nectar points on products sold and delivered by Trusted Sellers.

14.CUSTOMER CARE AND COMPLAINTS
14.1 Trusted Seller customer care: Trusted Sellers will manage all aftersales support once you place an order with them. You can contact Trusted Sellers directly via the Contact Seller function by visiting Order Details page.
14.2 Trusted Seller complaints: If you have a complaint, please contact the Trusted Seller in the first instance via the Contact Seller function. If you are not satisfied with the resolution provided by the Trusted Seller, you can access our dispute contact form via the Trusted Seller FAQs. We will work with you to resolve any issues promptly and fairly, and in any event, within 21 working days of the dispute being raised. 15.CHANGES TO THESE MARKETPLACE TERMS
15.1 We may update these Marketplace Terms to reflect legal or operational changes, or to implement reasonable technical adjustments and improvements. We'll post the updated Marketplace Terms and, for significant changes, notify you. Changes will have immediate effect but won't affect existing contracts already formed with Trusted Sellers.
15.2 If you keep using the Site after we make any significant changes, this means you accept those changes.

17.OTHER IMPORTANT TERMS
17.1 Governing law & jurisdiction. These Marketplace Terms and your contract with the Trusted Seller are governed by English law. Courts of England & Wales have jurisdiction. Customers that live in Scotland or Northern Ireland can also bring claims in the courts of the country they live in.
17.2 If a court finds part of these Terms unlawful. If a court finds that any part of these Marketplace Terms isn't valid, we'll remove or adjust only that part. Everything else will continue to apply as normal.
17.3 Third party rights. Except as stated, no one else has rights under these Terms under the Contracts (Rights of Third Parties) Act 1999.
